En lo que se refiere al servicio de conserjería, ha sostenido la Corte Constitucional que la contratación directa de personas y servicios de conserjería no es ilegal, lo que es ilegal es la contratación de servicios de conserjería que sean promovidas como seguridad privada su enfoque ilegal se guía en que estas personas sean contratadas para el cubrimiento de procesos y actividades de vigilancia y seguridad privada bajo el perfil de conserjería.
Esto quiere decir que las empresas prestadoras de servicios de vigilancia deben de explicarle a sus clientes que este servicio no es equivalente a una seguridad privada, pues este servicio va orientado realmente a la prestación de servicios de portería tales como recolección de documentos financieros, hacer cumplir el manual de convivencia de la copropiedad, abrir y cerrar las puertas del conjunto residencial, llevar a cabo un control de ingreso a personal externo a los copropietarios y lo más importante, avisar a las autoridades competentes en caso donde exista cualquier tipo de perturbación a los derechos de propiedad del conjunto residencial.
Esto quiere decir que en efecto, la conserjería es legal pues es un servicio de portería quien va orientado hacia unidades residenciales que poseen pocos apartamentos, pues este servicio tiene un precio mucho más bajo que el de una seguridad privada y siguie siendo muy eficiente para satisfacer las necesidades de la portería de los conjuntos. La diferencia entre ambos es que los conserjes se encargan de llevar a cabo todo el tema administrativo, organizacional y de prevención de la unidad, pues sus funciones son demasiado parecidas al de un guarda de seguridad, la diferencia es que estos porteros no ponen su vida en riesgo por no dejar entrar a un intruso con intensiones de hurto, estos avisan a las autoridades competentes para que se encarguen de la situación y así proteger a los copropietarios.
